Terms of Service

These Terms of Service (hereinafter referred to as "Terms") set forth the conditions for use of services (hereinafter referred to as "Service") provided by the Ennoshita Team (hereinafter referred to as "Team") on this website. Registered users (hereinafter referred to as "Users") shall use the Service in accordance with these Terms.

Article 1. Application and Definitions

1.1These Terms shall apply to all relationships between Users and the Team concerning the use of the Service.

1.2A Participant is deemed to have agreed to these Terms upon taking part in a Project, and these Terms also apply to the relationship between Participants and the Team.

1.3In these Terms, the terms listed in the following items have the meanings set out in those items:

  1. "Project" means an event that a User creates and runs using the Service.
  2. "Organizer" means a User who creates and runs a Project.
  3. "Participant" means a person who takes part in a Project created by an Organizer (whether or not they are registered).
  4. "Plan" means a category of usage fees displayed by the Team on this website.
  5. "Service Period" means the period of service corresponding to usage fees, as displayed by the Team on this website.
  6. "Upgrade" means a change by an Organizer to a higher Plan.
  7. "Gift" means digital content sold by the Team that Participants may purchase within the Service.
  8. "Coupons" means discount coupons, referral codes, activation codes, and other benefits issued by the Team.

Article 2. Registration

2.1Registration is completed when an applicant applies for registration in the manner specified by the Team and the Team approves it.

2.2The Team may not approve a registration application if it determines that the applicant has any of the following circumstances, and shall have no obligation to disclose the reasons:

  1. If false information was provided in the registration application
  2. If the application is from a person who has previously violated these Terms
  3. If the applicant is a minor, adult ward, person under curatorship, or person under assistance, and has not obtained consent from a legal representative, guardian, curator, or assistant
  4. If the Team determines that the applicant is associated with anti-social forces
  5. If the Team otherwise determines registration to be inappropriate

Article 3. Management of Email Address and Password

3.1Users shall manage the email address they registered for this Service and their password at their own responsibility.

3.2Users may not transfer or lend their registered email address and password to third parties under any circumstances. The Team shall deem login with a matching email address and password combination as use by the User who registered that email address.

Article 4. Usage Fees and Payment

4.1Users shall pay the usage fees separately determined by the Team and displayed on this website, by credit card payment or another method specified by the Team, as consideration for using the Service.

4.2Usage fees are fixed when the payment procedure is completed, and the Service Period corresponding to those fees shall be the period displayed by the Team on this website.

4.3Where an Upgrade is made, the Service Period is calculated from the date on which the Plan before the change was purchased, and is not extended by the Upgrade.

4.4When the Service Period expires, the relevant Project reverts to the conditions of the Plan available free of charge (including the limit on the number of participants and other functional restrictions). Expiry of the Service Period does not by itself delete the Project or posted data, but they may be deleted under Article 11.

4.5If a User delays payment of usage fees, the User shall pay late payment damages at an annual rate of 14.6%.

Article 5. Coupons and Activation Codes

5.1The Team may issue Coupons to promote use of the Service.

5.2The conditions of issue, discount amount, expiry date, number of permitted uses, and whether Coupons may be combined are determined by the Team and governed by the conditions notified at the time of issue. Coupons may not be available for transactions specified by the Team.

5.3An activation code is a Coupon that allows a Plan to be granted without requiring payment of usage fees. Even in that case, the Service Period and other conditions for that Plan are the same as when the Plan is purchased for a fee.

5.4Coupons may not be exchanged for cash, transferred, or lent to third parties. Coupons that have passed their expiry date lapse for any reason whatsoever.

5.5The Team may change or terminate Coupons and campaigns at any time without prior notice. If the Team determines that there has been improper or inappropriate use, the Team may invalidate the Coupon and demand return of an amount equivalent to any discount already applied.

Article 6. Gift Feature

6.1The sales contract for a Gift is formed between the Participant and the Team. The Organizer acts as an intermediary for such sales within the Service and bears no responsibility as a seller toward Participants.

6.2The sale price of a Gift is the amount displayed by the Team on this website (consumption tax included).

6.3A Gift purchase is fixed when the payment procedure is completed and, by its nature, returns, cancellations, and refunds after it is fixed shall not be made except where the Team approves them.

6.4A minor purchasing a Gift shall do so only after obtaining the consent of a person with parental authority or another legal representative.

Article 7. Sales Commission for Gifts

7.1As consideration for mediating the sales described in Paragraph 1 of the preceding Article, the Team shall pay the Organizer a sales commission. The amount of the sales commission is the total Gift sales, less 20% of those total sales (rounded up to the nearest yen) and less the withdrawal fee determined by the Team (400 yen per transfer); that rate and that amount both include consumption tax.

7.2The sales commission is calculated for each purchase of a Plan (including a Plan granted by an activation code), covering the Gifts sold during the Service Period for that purchase. Where there are multiple purchases for the same Project, the commission is calculated separately for each purchase and the purchases are not aggregated.

7.3To receive the sales commission, the Organizer shall register a bank account by the deadline set by the Team, using the method specified by the Team. That deadline is the date one month after the day on which the Service Period for that purchase expires. However, if a transfer to the registered bank account fails, that deadline is extended to the date one month after the date of that failure. The Team may send the Organizer reminders to register a bank account until that deadline.

7.4If no bank account is registered by the deadline in the preceding paragraph, or if a state in which transfer to the registered account is not possible remains unresolved after that deadline, the Organizer forfeits the right to receive the sales commission. In addition, if the resulting amount is less than one yen, no sales commission will be paid.

7.5The Team will pay the sales commission by transfer to the bank account registered by the Organizer.

Article 8. Prohibited Activities

8.1Users shall not engage in the following activities when using the Service:

  1. Acts that violate laws or public order and morals
  2. Acts related to criminal activities
  3. Acts that destroy or interfere with the Team's server or network functions
  4. Acts that may interfere with the operation of the Team's service
  5. Acts of collecting or accumulating personal information about other Users
  6. Acts of impersonating other Users
  7. Acts that directly or indirectly provide benefits to anti-social forces in connection with the Team's service
  8. Acts that infringe on intellectual property rights, portrait rights, privacy, honor, or other rights or interests of the Team, other Users, or third parties
  9. Posting or sending expressions that are excessively violent, sexually explicit, discriminatory, or anti-social
  10. Commercial activities, advertising, solicitation, or other for-profit activities (except those approved by the Team)
  11. Religious activities or solicitation to religious organizations
  12. Other acts that the Team deems inappropriate

Article 9. Suspension of Service

9.1The Team may suspend or interrupt all or part of the Service without prior notice to Users if it determines that any of the following circumstances exist:

  1. When performing maintenance or updating the computer system for the Service
  2. When provision of the Service becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters
  3. When computers or communication lines are stopped due to an accident
  4. When the Team otherwise determines that provision of the Service is difficult

9.2The Team shall not be liable for any disadvantage or damage incurred by Users or third parties due to suspension or interruption of the Service, regardless of the reason.

Article 10. Copyright

10.1Users may only post or edit text, images, videos, and other information using the Service for which they have the necessary intellectual property rights or have obtained permission from the rights holders.

10.2Copyrights to text, images, videos, etc. posted or edited using the Service shall remain with the User and other existing rights holders. However, the Team may use such content, and Users shall not exercise moral rights of authorship regarding this use.

10.3Except as provided in the preceding paragraph, copyrights and other intellectual property rights for the Service and all related information belong to the Team or rights holders who have licensed the Team, and Users may not reproduce, transfer, lend, translate, modify, repost, publicly transmit, distribute, publish, or commercially use such content without authorization.

Article 11. Usage Restrictions and Deregistration

11.1The Team may delete posted data, restrict all or part of the User's use of the Service, or deregister the User without prior notice in the following cases:

  1. If the User violates any provision of these Terms
  2. If false information is discovered in the registered information
  3. In case of bankruptcy, civil rehabilitation, corporate reorganization, or special liquidation proceedings
  4. If the Service has not been used for more than one year
  5. If there is no response for more than 30 days to inquiries or other communications from the Team
  6. If any of the items in Article 2, Paragraph 2 apply
  7. If the Team otherwise determines that use of the Service is inappropriate

11.2If any of the items in the preceding paragraph apply, the User shall naturally lose the benefit of time for all debts to the Team and must immediately pay all debts owed at that time in a lump sum.

11.3The Team shall not be liable for any damages incurred by Users due to actions taken by the Team under this article.

Article 12. Withdrawal

12.1Users may withdraw from the Service at any time using the method specified by the Team.

12.2Even after withdrawal, usage fees already paid will not be refunded, and no refund will be made for the unused portion of a Plan within its Service Period, except where the Team approves it.

12.3If, at the time of withdrawal, any sales commission under Article 7 remains unpaid, the Organizer forfeits the right to receive that sales commission.

Article 13. Disclaimer

13.1The Team does not expressly or impliedly warrant that the Service is free from factual or legal defects (including defects relating to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors, bugs, or rights infringements).

13.2The Team shall not be liable for any damages arising to Users from the Service. However, if the contract between the Team and Users regarding the Service (including these Terms) constitutes a consumer contract as defined in the Consumer Contract Act, this disclaimer shall not apply.

13.3Even in cases under the proviso of the preceding paragraph, the Team shall not be liable for any damages arising from special circumstances (including cases where the Team or Users foresaw or could have foreseen the occurrence of damages) due to breach of contract or tort by the Team's negligence (excluding gross negligence). Furthermore, compensation for damages caused to Users by breach of contract or tort due to the Team's negligence (excluding gross negligence) shall be limited to the amount of usage fees received from the User in the month when the damage occurred.

13.4The Team shall not be liable for any transactions, communications, or disputes between Users and other Users or third parties in connection with the Service.

Article 14. Changes to Service Content

14.1The Team may change the content of the Service or discontinue the Service without notice to Users, and shall not be liable for any damages arising to Users from such changes.

Article 15. Changes to Terms of Service

15.1The Team may change these Terms at any time without notice to Users if deemed necessary.

Article 16. Notices and Communications

16.1Notices or communications between Users and the Team shall be made in the manner specified by the Team.

Article 17. Prohibition of Assignment of Rights and Obligations

17.1Users may not assign or provide as security their status under the usage contract or rights or obligations under these Terms to a third party without prior written consent of the Team.

Article 18. Governing Law and Jurisdiction

18.1Japanese law shall be the governing law for interpreting these Terms.

18.2In the event of a dispute regarding the Service, the court having jurisdiction over the location of the Team's head office shall have exclusive agreed jurisdiction.
